Terms of Service

1. Introduction and Acceptance of Terms
These Terms of Service (“Terms”) govern the provision of painting and related services by Harbourline Painting Solutions (“Harbourline Painting Solutions,” “we,” “us,” or “our”) to customers, clients, and other users of our services (“you” or “customer”). By requesting a quotation, booking, confirming an order, permitting us to commence work, or otherwise engaging our services, you acknowledge that you have read, understood, and agreed to be bound by these Terms.
If you do not agree to these Terms, you must not engage our services. Any additional terms proposed by you shall not apply unless expressly agreed in writing by Harbourline Painting Solutions.
2. Scope of Services
Harbourline Painting Solutions provides painting and surface coating services, including but not limited to:
- Interior wall painting;
- Exterior building painting;
- Office repainting;
- Residential apartment painting;
- Waterproof coating application; and
- Woodwork and trim painting.
Our services may include site inspection, surface preparation, priming, painting, coating application, touch-up work, and cleanup, as specified in the relevant quotation, work order, or service agreement. Any services not expressly included in the quotation or work order are excluded unless agreed in writing.
We may recommend paint systems, materials, colours, and application methods based on site conditions. However, final selection and approval remain your responsibility unless otherwise agreed in writing.
3. User Obligations and Responsibilities
You agree to:
- Provide accurate and complete information regarding the premises, surfaces, access conditions, and any known defects, hazards, or special requirements;
- Ensure that we have safe, lawful, and timely access to the worksite during agreed working hours;
- Obtain all necessary permissions, approvals, consents, and licences required for the work, including consent from landlords, building management, owners’ corporations, tenants, or other relevant parties where applicable;
- Remove or protect personal belongings, valuables, furniture, electronics, and fragile items unless otherwise agreed in writing;
- Ensure that the work area is reasonably clear and suitable for the performance of the services;
- Inform us of any hidden defects, dampness, mould, structural issues, asbestos, lead paint, hazardous materials, pest infestations, or other conditions that may affect the work or safety;
- Comply with all applicable laws, building rules, and safety requirements; and
- Review and promptly notify us of any concerns regarding the services or completed work.
You acknowledge that failure to fulfil these obligations may result in delays, additional charges, suspension of work, or limitations on our liability.
4. Payment Terms and Conditions
All fees, charges, and payment schedules shall be as stated in the quotation, invoice, or work order issued by Harbourline Painting Solutions. Unless otherwise agreed in writing:
- Quotations are valid for the period stated in the quotation or, if no period is stated, for 30 days from the date of issue;
- A deposit may be required before commencement of work;
- Progress payments may be required for larger projects;
- Final payment is due upon completion of the services or within the period stated on the invoice, whichever applies;
- All payments must be made in Hong Kong dollars (HKD) unless otherwise agreed;
- Late payments may incur interest and/or administrative charges to the extent permitted by law and as stated in the invoice or quotation;
- You are responsible for any bank charges, transfer fees, or payment processing fees charged by your financial institution or payment provider.
If payment is overdue, we may suspend work, withhold delivery of completed work, or take reasonable steps to recover outstanding amounts, including legal action and recovery of reasonable costs incurred in collection, to the extent permitted by Hong Kong law.
Any variation, additional work, or unforeseen remedial work requested by you or required due to site conditions may be charged separately.
5. Cancellation and Refund Policy
You may request cancellation of a booking by providing written notice to Harbourline Painting Solutions. Cancellation terms are as follows, unless otherwise stated in the quotation or work order:
- If cancellation occurs before materials are ordered or work is scheduled, any deposit may be refundable less reasonable administrative costs, if applicable;
- If cancellation occurs after materials are ordered, site preparation has begun, or labour has been reserved, we may retain all or part of the deposit to cover costs and losses incurred;
- If cancellation occurs after work has commenced, you must pay for all work performed, materials used or ordered, and any non-recoverable costs incurred up to the date of cancellation;
- Rescheduling requests are subject to our availability and may incur additional charges if costs are incurred as a result of the change.
Refunds, if any, will be processed within a reasonable time after the amount due has been determined. No refund will be provided for completed services that conform to the agreed scope, except where required by law or expressly agreed in writing.
Natural variations in colour, finish, sheen, texture, or appearance may occur due to surface conditions, lighting, product characteristics, or environmental factors and do not constitute a defect unless otherwise agreed in writing.
6. Liability Limitations
To the maximum extent permitted by Hong Kong law, Harbourline Painting Solutions shall not be liable for:
- Indirect, incidental, special, consequential, or punitive losses or damages;
- Loss of profit, loss of business, loss of opportunity, or loss of goodwill;
- Damage arising from pre-existing defects, structural issues, dampness, mould, water ingress, hidden conditions, or defective substrates;
- Damage caused by inaccurate information provided by you or by failure to follow our instructions;
- Damage resulting from items not removed or adequately protected by you;
- Delays caused by weather, access restrictions, building management rules, supply shortages, or events beyond our reasonable control.
Where liability cannot be excluded under applicable law, our total aggregate liability arising out of or in connection with the services shall be limited, at our option, to either:
- the re-performance of the relevant services; or
- the amount paid by you for the specific services giving rise to the claim.
Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, or any liability that cannot lawfully be excluded under Hong Kong law.
7. Intellectual Property Rights
All intellectual property rights in our quotations, proposals, drawings, specifications, photographs, documents, designs, methods, templates, and other materials created or supplied by Harbourline Painting Solutions remain our property unless expressly transferred in writing.
You may not copy, reproduce, distribute, modify, or use our materials for any purpose other than receiving and evaluating our services, without our prior written consent.
Where we provide colour recommendations, finish suggestions, or project documentation, such materials are provided for your internal use in connection with the relevant project only.
We may take photographs or videos of the worksite, surfaces, and completed work for quality control, record-keeping, training, and marketing purposes, provided that any personal data is handled in accordance with our privacy obligations and applicable law.
8. Data Protection and Privacy
Harbourline Painting Solutions collects, uses, stores, and processes personal data only as necessary to provide our services, manage customer relationships, issue quotations and invoices, comply with legal obligations, and operate our business.
We will handle personal data in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong and any applicable data protection requirements. Personal data may include your name, contact details, address, billing information, site access details, and communications relating to the services.
We may disclose personal data to:
- Our employees, contractors, and service providers who need the information to perform the services;
- Payment processors, banks, accountants, insurers, and legal advisers;
- Building management, owners’ corporations, or other parties where necessary to arrange access or comply with site requirements;
- Government authorities, regulators, or law enforcement where required by law.
You have the right to request access to or correction of your personal data, subject to applicable legal exceptions. Requests or privacy-related enquiries should be directed to our contact details set out below.
9. Force Majeure
Harbourline Painting Solutions shall not be liable for any delay or failure to perform our obligations where such delay or failure is caused by events beyond our reasonable control, including but not limited to:
- Typhoons, heavy rain, flooding, extreme weather, or other adverse weather conditions;
- Fire, explosion, accident, or natural disaster;
- War, terrorism, civil unrest, strikes, labour disputes, or industrial action;
- Government action, legal restrictions, building access restrictions, or regulatory changes;
- Supply chain disruptions, material shortages, or transportation delays;
- Power outages, utility failures, or internet/telecommunications disruptions.
Where a force majeure event occurs, we may suspend work, extend timelines, or reschedule services without liability, and any affected obligations shall be performed as soon as reasonably practicable after the event ends.
10. Changes to Terms
Harbourline Painting Solutions may update or amend these Terms from time to time to reflect changes in our business practices, legal requirements, or service offerings. The updated Terms will take effect upon publication or upon notice to you, as applicable.
Your continued engagement of our services after any change constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue use of our services and notify us in writing before further work is performed.
11. Applicable Law and Jurisdiction
These Terms and any dispute, claim, or matter arising out of or in connection with them, whether contractual or non-contractual, shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region.
The parties submit to the exclusive jurisdiction of the courts of Hong Kong, except where mandatory law provides otherwise.

13. Severability Clause
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or competent authority, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, it shall be severed from these Terms.
The remaining provisions shall continue in full force and effect. No invalidity or unenforceability of any provision shall affect the validity or enforceability of the remaining provisions.
